One of America’s Founders, Mercy Otis Warren, gives us a great deal to talk about in her quote:

“Thus we have seen…the many become slaves of the few; preferring the wretched tranqulity of inglorious ease, they patiently yield to despotic masters, until awakened by multiple wrongs; which once aroused to a consciousness of freedom…ever revolts at the idea of servtitude.”

Think about those phrases: “tranquility of inglorious ease” and “patiently yield to despotic masters.”

Sometimes, and I mean this quite genuinely, my heart and soul weeps violently over the modern American condition. Sometimes it feels like it is not possible that anyone could love America more than I do. I am certain that it is not true, but the depth of my emotion sure makes it feel like it sometimes. I don’t love America because of the majestic mountains, fields of grain, or the flag that represents our Republic. I love our American Union because I love Liberty. I love Liberty because I love the God that authored it. I love Him & I love His gifts with all my heart & soul.

So when I see my fellow brothers & sisters who speak fidelity to America, yet seek the solutions that bring about the opposite of Liberty, I can sometimes hardly hold back my emotions. I know this is not a new affliction. Hannah Winthrop said, “How often do we see people blind to their own interests precipitately maddening on to their own destruction!” We do so because we have been trained in lies and error. We do so because we have been deceived, distracted, and convinced we are defeated before we even try.

Meditate on these words written by Thomas Jefferson in 1807:

“It is a melancholy truth, that a suppression of the press could not more compleatly deprive the nation of it’s benefits, than is done by it’s abandoned prostitution to falsehood. Nothing can now be believed which is seen in a newspaper. Truth itself becomes suspicious by being put into that polluted vehicle. The real extent of this state of misinformation is known only to those who are in situations to confront facts within their knolege with the lies of the day. I really look with commiseration over the great body of my fellow citizens, who, reading newspapers, live & die in the belief, that they have known something of what has been passing in the world in their time; whereas the accounts they have read in newspapers are just as true a history of any other period of the world as of the present, except that the real names of the day are affixed to their fables.”

America’s media & politicians have become nothing but a source of sickening and toxic blither, whose only purpose is to divide Americans through contrived and artificial standards. They work to keep us hating each other so we cannot see the REAL enemy nor can we join together in Liberty and be truly free. We are enslaving ourselves at their command and we do not even realize it.

Americans are like the battered spouse and the politicians and the media are like our abusers; every day, constantly berating us into believing that we are ugly, we are worthless, we are stupid, and we are nothing without them; beating our spirits daily while smiling and whispering in our ear how much they truly love us. Like a controlling abuser, they isolate us from each other so we cannot know truth and we cannot find the power in each other to escape their foul clutches.

These abusers are causing us to enslave ourselves through their messages of hate, division, fear & partisan isolation. However, my fear is that we may be close to believing the lies of our abusers and that we are drifting further and further from the one thing that is our true love and salvation… The love of Christ that sets us free and gives us the Power & Ability to love our neighbor as ourselves. When the heart is full of vitriol then the spirit cannot be free. Our enemy is not each other. Our enemy are those who teach and encourage us to hate each other.

There have been times throughout our history that Americans have come together, in all colors, creeds, and genders, united in the name of Liberty & Justice for all. THAT is WHO America is in her spirit. We need reconnect with that spirit and look our abusers in they eye and boldly proclaim, “You have no power over me.” We need to unite, every American, regardless of skin color, political party, economic status, or geography- unite in the one thing that makes us all equal- LIBERTY. We have had victory before and we will have victory again. There is only one way- unified, together, in Liberty.

I will end these thoughts with a quote from Patrick Henry:

“What is it that gentlemen wish? What would they have? Is life so dear, or peace so sweet, as to be purchased at the price of chains and slavery? Forbid it, Almighty God! I know not what course others may take; but as for me, give me liberty or give me death!”

We must want Liberty more than comfort. We must understand that without liberty our peace becomes our chains and bonds.

July 2, The Real Day Of Independence

The True Day For Celebration

July 2nd is actually America’s #IndependenceDay

Our Independence was not the product of the Declaration of Independence, signed by John Hancock on July 4, 1776. On the contrary, the Declaration of Independence was the product of our Independence!

On June 7, 1776 a delegate from Virginia by the name of Richard Henry Lee proposed the “Lee Resolution.” The Lee Resolution was the 3 step process of declaring independence from our then government of Great Britain. The first clause of the Lee Resolution proposed:

“That these United Colonies are, and of right ought to be, free and independent States, that they are absolved from all allegiance to the British Crown, and that all political connection between them and the State of Great Britain is, and ought to be, totally dissolved;”

On July 2, 1776 the Lee Resolution was brought to the Continental Congress floor. It was debated, voted, and ratified into law by 12 of the 13 colonies, New York abstaining because the delegates claimed they were unsure of how their constituents wanted them to vote. Upon ratification of the Lee Resolution, our 13 colonies, became 13 independent sovereign governments. We were from that day forward no longer colonies, each State was then and there independent.

Our Independence Was a Legally Created Legislative Act just as binding as anything our Congress does today that is richard henry lee 244x300Constitutional.

Without the passing of the Lee Resolution, there would have been nothing to declare in the Declaration of Independence. As a matter of fact, the Declaration of Independence does not even claim to be the source of our independence, it merely boasts to be its declaration:

“We, therefore, the Representatives of the united States of America, in General Congress, Assembled, appealing to the Supreme Judge of the world for the rectitude of our intentions, do, in the Name, and by Authority of the good People of these Colonies, solemnly PUBLISH and DECLARE…”

The Declaration of Independence then goes on to quote the first clause of the Lee Resolution in its text.

Our founders did not establish July 4th as Independence Day, that was an honor given to July 2nd. John Adams documents this honor in a letter to his wife, Abigail on July 3, 1776:

“The Second Day of July 1776, will be the most memorable Epocha, in the History of America.
—I am apt to believe that it will be celebrated, by succeeding Generations, as the great anniversary Festival.

It ought to be commemorated, as the Day of Deliverance by solemn Acts of Devotion to God Almighty. It ought to be solemnized with Pomp and Parade, with Shews, Games, Sports, Guns, Bells, Bonfires and Illuminations from one End of this Continent to the other from this Time forward forever more.”

It Wasn’t Until 1870 That July 4th Became the National Holiday for commemoration of our independence.

I thoroughly enjoy listening to and helping my wife, KrisAnne Hall dissect the legal opinions of this current Supreme Court.  I have discovered that going through these opinions is one of the best ways to learn about how our system is functioning, as opposed to how it should be functioning.  It has also been extremely clarifying to see the blind spots and ideological biases of the various Justices.  The US v Davis case is yet another fascinating glimpse into the Constitutional views of the All-powerful Nine-member Band. In this case Justice Gorsuch delivers another powerful defense of Constitutional principles.

In writing the majority opinion for US v Davis, Gorsuch sides with the late Justice Antonin Scalia (Johnson v US).  Gorsuch holds in Davis that overly vague criminal laws offend both due process and separation of powers – due process, by failing to give individuals a clear definition of forbidden activity; separation of powers, by forcing the courts, not Congress, to define criminal conduct. 

Justice Scalia put the first nail in the coffin in 2015 with his majority opinion in Johnson v US.  In Johnson, Scalia declared the very same statutory language before the court in Davis, to be vague and unconstitutional.  Justice Scalia wrote, “Government violates this guarantee (due process) by taking away someone’s life, liberty, or property under a criminal law so vague that it fails to give ordinary people fair notice of the conduct it punishes, or so standardless that it invites arbitrary enforcement.” (as an aside, too bad Scalia didn’t seem to hold this view consistently when it came to Kelo v New London)

The Supreme Court dealt with the phrase again in April 2018 in Sessions v Dimaya. The majority explained that the Constitution disallowing vague laws, “guards against arbitrary or discriminatory law enforcement by insisting that a statute provide standards to govern the actions of police officers, prosecutors, juries, and judges.”  Counting US v Davis, the vague language in these statutes has now struck out three times.  Since Gorsuch may have dealt the decisive blow, some may start to notice that his consistent liberty-minded approach on this issue is a real threat to the bipartisan fetish for big government.

Gorsuch seems to operate on a consistent principle that vague statues run afoul of the Constitution.  If a citizen cannot know what the law demands of him, then his liberty is in jeopardy.  This stirs the ire of both regulatory-minded, control-freak leftists and statist, police-state conservatives.

In the case of civil statutes that empower the government’s vast regulatory behemoth Gorsuch says, “Congress must set forth standards sufficiently definite and precise to enable Congress, the courts, and the public to ascertain whether Congress’s guidance has been followed….A statute that does not contain ‘sufficiently definite and precise’ standards ‘to enable Congress, the courts, and the public to ascertain’ whether Congress’s guidance has been followed at once presents a delegation problem and provides impermissibly vague guidance to affected citizens.”  This angers the new, green Marxists. They need vague regulatory authority for unelected bureaucrats to have free reign to legislate through the unaccountable “fourth-branch” of our post-constitutional government.

In the case of criminal statutes, Gorsuch holds that, “In our constitutional order, a vague law is no law at all. Only the people’s elected representatives in Congress have the power to write new federal criminal laws. And when Congress exercises that power, it has to write statutes that give ordinary people fair warning about what the law demands of them.”   This angers the police-state conservatives who wish to empower the government to run roughshod over the citizens’ liberty in order to stop a “bad guy” from doing “bad things” and then throw the book at him with as many sentence enhancements as possible. (Let’s set aside for a moment the argument that Congress lacks authority to make federal law regarding things NOT FEDERAL in the first place. That’s a blog for another day.)

Kavanaugh, for his part, did his best to make the police-state argument, “Bad guy do bad things. Bad guy must pay.”  His dissenting rant against gun ownership as being violent “by its very nature,” has him sounding like some raving leftist, gun-grabber from the House of Representatives, proving that a statist is a statist no matter if he sits on the left side of the sofa or the right.

Since SCOTUS is increasingly seen as the final oracle of truth on all matters whatsoever, we will see how Congress, judges, and others in the legal system adjust to this blow to vague statutory language.  Destroying this “wiggle room,” as our founders intended, would be a significant bulwark against the assaults on individual liberty by the regulatory state as well as by the police state.  Unfortunately, many Americans will miss the significance of this opinion since so many have been programmed to think in binary terms of left and right. So, they typically interpret SCOTUS opinions like the rest of their reality, by counting the number of “left supporters” versus the number of “right supporters.”  So, 99 times out of 100, this story will be reported and interpreted as “Gorsuch sides with left,” or “Conservative Duel: Gorsuch v Kavanaugh.”  There is only one dichotomy that matters, Liberty versus Tyranny.  None of these guys are perfect, but thus far Gorsuch seems to hold to the principles of liberty more consistently than any of his colleagues.

So often I hear from well-intentioned people, “it’s too late to fix what’s wrong with our federal government” or “The government is out of control, it’s a good things we have the 2nd Amendment.” These statements truly break my heart to the core and here is why:

It is not “too late” and “the right to keep & bear arms” is not our only recourse. We are NOT fighting a king nor do we live in a kingdom. Regardless of how the federal government behaves, we are a Constitutional Republic.

With all due respect to everyone who visits this page- “too late” and “pick up arms” are the lazy, apathetic, and to the extreme- cowardice ways to deal with unlawful acts of our government. Whether it will be admitted or not, both of those statements are the exact same consequence: giving up. Our founders sacrificed EVERYTHING so “too late” & “pick up arms” are NOT the only and not our first options.

The tragedy of all of this that Americans have become so deceived, distracted, and discouraged by errant education & political propaganda that we have been trained into ignorance. As a consequence we feel defeated before we even begin and the absolute truth is- we haven’t even begun to use the tools given to us to remedy this government’s lawlessness.

There are so many things we ought to be doing, and so many things we must do before we give up. Americans must become educated on the problems & the solutions- because giving up can NEVER be an option & picking up arms should be recognized as sentencing our children and grandchildren to fight a war WE could have avoided with persistent, pro-active, and unrelenting peaceful acts, the acts of a people who know they are members of a Constitutional Republic and not deceived into acting as nothing more than subjects to a king.

So get miffed at the bluntness of my speech, but the truth remains the same. Don’t tell me there is nothing we can do. Madison, Jefferson, Mason, Warren, Otis, Attucks, & thousands more went to their graves disagreeing with you.

The “vetted” history textbooks in our education systems of both K-12 and post-secondary are replete with vital omissions and intentional deceptions regarding the formation of America, our battle for independence and the creation of our Constitution.  These errors have become so widespread and are taught with such “authority” that the majority of Americans, those who consider themselves conservative and liberal alike, have very little immediate access to information that speaks truth.  Even former president Barack Obama used this errant teaching of history to justify the government’s dismantling of Americans’ 4th Amendment requirements. In a speech delivered regarding National Security Agency data collection programs, the Obama gave this twisted distortion of American history:

“At the dawn of our Republic, a small, secret surveillance committee, born out of the Sons of Liberty, was established in Boston. And the group’s members included Paul Revere. At night, they would patrol the streets, reporting any signs that the British were preparing raids against America’s early Patriots. Throughout American history, intelligence has helped secure our country and our freedoms.”

It is hard to believe that some speechwriter could so shamelessly coopt the fight for liberty to justify the modern surveillance state. On the other hand, given the progressive education that the majority of our citizens have been brainwashed to believe maybe he thought nobody would notice or even believed his own words to be truth. What do you say we shed the light of TRUTH on this mind-manipulating rewrite of American history?

The Revolutionary War Was Not A Battle Between The British And Americans

It was a battle between British Colonists and their government. It was a battle to win independence from government intrusion, denial of liberty, and government control. It was a civil war, not a foreign war.

The Sons Of Liberty Were Birthed By Colonists Who Were Fed Up With The Government’s Intrusion Upon Their Privacy, Property And Denial Of Their Rights

It all began in February 1761 when James Otis, Jr., a former government attorney, brought a lawsuit against the government for its blatant violations of the colonists’ rights to privacy and security of property from warrantless searches and seizures. Otis blew the cover off the British tool called “Writs of Assistance.” These Writs were authority given to government agents, by law, that permitted these agents to arbitrarily demand access to colonists’ homes and businesses to search and seized anything the government agents determined to be suspicious.

Otis had been in charge of the execution of these warrantless searches and prosecutions that resulted from the seizures. He began to realize just how tyrannical these Writs were.   He called them, “The worst instruments of arbitrary power, the most destructive of English Liberty ever found in an English law book.” When Otis was approached by some colonists who were victims of this arbitrary power, he decided to resign his post and take up a legal battle to secure the Liberty of the Colonists.

The Colonists had a long established right to the security of their property and to due process rights. Otis was there to defend them.

Otis argued for five hours, fighting the government in their courtroom. He lost the legal fight but birthed a spirit of independence in the hearts and minds of the colonists. This is what John Adams said about that day in court.

“But Otis was a flame of fire! With a promptitude of classical allusions, a depth of research, a rapid summary of historical events and dates, a profusion of legal authorities, a prophetic glare of his eyes into (the future), and a rapid torrent of impetuous eloquence, he hurried away all before him…American Independence was then and there born. The seeds of Patriots and Heroes – to defend the vigorous youth, were then and there sown. Every man of an immense, crowded audience, appeared to me to go away, as I did, ready to take up arms against Writs of Assistance. Then, and there, was the first scene of the first act of opposition to the arbitrary claims of Great Britain – then and there, the child of Independence was born. In fifteen years, namely in 1776, he grew up to man hood, and declared himself free.” (John Adams to William Tudor 29 March 1817);

Also in that courtroom that day were Samuel Adams and many of the other men who would become the founders of our Constitutional Republic. Sam Adams left that courtroom inspired to form the Committees of Correspondence, a citizen coalition group whose purpose was to connect the Liberty minded Colonists and help educate each other on the TRUTH in the face of government media propaganda.

The Sons of Liberty were the action group birthed out of the inspired members of the Committees of Correspondence.

The Sons Of Liberty Were Not A Government Surveillance Program

As a matter of fact, they were quite the opposite. The Sons of Liberty held rallies and protests against the government’s denial of their rights to privacy and due process. The protests took the form of mock hangings and mock funeral processions of government agents.   They were engaged in ANTI-GOVERNMENT surveillance defending Liberty from a government who was refusing to abide by their Constitutional Charters.

Our Battle For Independence was NOT About a Tax on Tea

Perhaps one of the greatest manipulations of the people through errant education of our history is the fallacy that we went to civil war with our own government, neighbors, brothers, and sisters in 1776 because of a tax on tea.  Nothing could be further from the truth.  The fact is that the tea had become a symbol of a much greater and larger despotism.  On January 1, 1774, founding mother Hannah Winthrop wrote to Mercy Otis Warren:

“Yonder, the destruction of the detestable weed, made so by cruel exaction, engages our attention. The virtuous and noble resolution of America’s sons, in defiance of threatened desolation and misery from arbitrary despots, demands our highest regard.”

Arbitrary despotism was the problem, not a tax on tea!  Since the early 1700s, under the rule of George II, the American Colonists were experiencing a gradual and ever increasing infringement of their rights; legislation without representation, complete government control of commerce, private businesses, the market place, warrantless searches and seizures, denials of due process, and imposition of foreign law just to name a few.  These blatant violations of the Rights of the colonists did not happen all at once, but so gradually that only a few noticed (Benjamin Franklin started writing about them in 1722).  By the time the tea was cast into the harbor, the people were being subjected to complete and despotic martial law, not because of threat of foreign war, but because the PEOPLE were standing up and speaking out against the government’s violation of their Rights; Rights that had been codified in English Law since 1100 AD.

Yet our textbooks still teach that the battle for independence was about a 3% consumption tax.  Perhaps if the people can be convinced that it was “high taxes” that caused us to fight for independence, then all the government needs to do to keep people pacified, complacent, and compliant is to make sure the taxes don’t get “too high.”  Meanwhile an unsuspecting people, disarmed of the wisdom of history, happily cling to their paper currency while once again their liberties are eroded by government despotism without notice.  If you are still skeptical about this truth, look at the Declaration of Independence; you will notice that taxation is the seventeenth grievance.  If the taxation had been the cause, surely it would’ve made it to the top five.  

Patrick Henry didn’t say, “Give me lower taxes or give me death.”  Our founders were not trying to create a stronger economy.  They were fighting for their lives to secure Liberty.  John Adams said it very plainly in 1765:

“Liberty must at all hazards be supported. We have a right to it, derived from our Maker. But if we had not, our fathers have earned and bought it for us, at the expense of their ease, their estates, their pleasure, and their blood.”

Those Who Do Not Know Their History Are Doomed To Repeat Its Mistakes

If those in power can rewrite our history to the point where Patriots fighting for Liberty become the very government oppressors they battled, we will become enslaved and never even know it. I am reminded of what Thomas Paine said about THEIR King in his dissertation called, “Common Sense”:

“He may accomplish by craft and subtlety in the long run, what he cannot do by force or violence in the short one.”

This blatant and ubiquitous distortion of reality has only one purpose – To convince the masses to submit to a level of government control that can only be equated to tyrannical Kings and Kingdoms. Our founders did not accept such tyrannical abuse of their God-given rights and we should not accept it now.

“I will to my dying day oppose, with all the powers and faculties God has given me, all the instruments of slavery on the one hand and villainy on the other as this Writs of Assistance is.”  James Otis, Jr.

What is the difference between this history and the history taught in today’s institutions of “education?” This one is based in fact and there’s is purely fiction.
