This past week both YouTube and Spotify decided to ban Alex Jones and the discussion over free speech and corporate power erupted across America.  What is the proper application of free speech?  What happens to the rights of a private business when they become entangled with government?  Some are even saying that Jones’ speech is so offensive he needs to be banned.  Some politicians are even calling for more censoring of speech.  But Benjamin Franklin wrote in 1772 when he was only 16 years old:

“Without Freedom of Thought, there can be no such Thing as Wisdom; and no such Thing as publick Liberty, without Freedom of Speech; which is the Right of every Man, as far as by it, he does not hurt or controul the Right of another: And this is the only Check it ought to suffer, and the only Bounds it ought to know.”

Freedom of speech is not the threat.  Offensive speech is not the threat.  However, when American believe the solution is to censor speech, our founder’s would tell us that Liberty is lost.  Americans must demand a truly free market place of ideas.  However, Americans are going to have to be properly educated if we are to restore the standards of Liberty.  Thomas Jefferson said in a letter to Charles Yancey in 1816, ” if a nation expects to be ignorant & free, in a state of civilisation (sic), it expects what never was & never will be.”

Donald Trump, Twitter, & The First Amendment

President Trump has been blocking people from his @realDonaldTrump account.  A federal judge says Trump is violating the First Amendment.  Is the Right to freedom of speech being violated by Trump through his actions on Twitter.  The answer to this question requires a two step process.

First, Twitter is a private forum, run by a private company.  Something only becomes a violation of Rights when the government is the offender.  People do not have their Rights violated when Twitter, as a private company, censors and blocks persons from their forum.  Private businesses still retain the right to refuse to do business with customers, regardless of the confusion created by the recent issues with photographers and cake bakers.  Additionally, people do not have their Rights violated when they are blocked on Twitter by another private individual.  The principle is: No government actor, no violations of Rights.

But this is not a question of Twitter blocking customers.  This is a question of the president of the United States, a government actor, blocking discussion from his Twitter feed.  So the question is Donald Trump a private citizen or a government actor?

The argument could be made that the @realDonaldTrump account is Trump’s personal account and as a private account maintained by a private citizen, people being blocked do not have their Rights being violated.  However that argument fails the moment Donald Trump voluntarily discusses “presidential business” on this “private” account.  Trump transforms his private account into the account of a government agent through his own actions whenever he tweets about his affairs and opinions as president.  Since Donald Trump is president he is a government agent.  Since Trump uses his Twitter account to discuss presidential business the account is not private, it becomes a public forum.  Therefore, those blocked by Trump on his @realDonaldTrump account are having their voice silenced by a government actor regarding public affairs.  This is a clear violation of the Right to freedom of speech.

To allow a government agent to conduct public business, yet hide behind the claim of a “private” account literally negates the entire purpose of the First Amendment: to be able to openly and publicly criticize those in office in what ever forum is available (Freedom of Press).  Trump chooses the forum of Twitter to conduct public business, so he must accept that forum for its praise and criticism.

The quick fix for Mr. Trump is to stop using the @realDonaldTrump account to discuss public business and reserve that account for truly private matters.  He must confine the presidential conversations to the @POTUS account.  That way he may maintain control over his truly private account and leave government business to the government account.

The right to protest and the right to freedom of expression are fundamental to any free people. Disagreeing with the protest content doesn’t annul the protester’s right. But should protests be subsidized by American tax dollars? Does a multi-billion dollar entertainment industry need to be subsidized by American tax dollars?

As the debate over “Trump v. NFL” rages, how many Americans know how much funding their State and local governments provide to the NFL, so that a family can spend several hundred dollars for the privilege of watching this tax subsidized event?

Taxpayers at the State and municipal level have built and currently maintain a number of the stadiums that the NFL utilizes. Most teams pay only a modest rent, and some, like the New Orleans Saints, pay no rent at all. Yet, all ticket sales, concessions and parking, revenue goes to the team owners. Additionally, the teams are not required to pay sales tax on those revenues in most States. A study by the Times-Picayune in 2016 reported the New Orleans Saint’s receives yearly around $165 million, from the taxpayers of Louisiana. In Texas, the value of the Dallas Cowboys is $4.2 billion. The new Cowboy’s stadium, now-AT&T Stadium, was the first billion-dollar football stadium in the United States. It received $444 million from taxpayers.

How much do you pay your NFL team? Wouldn’t that make the staff and players of the NFL government employees?

While the taxpayers unknowingly or foolishly subsidized the creation and operation of the NFL’s “product,” hoping for a few minimum wage jobs in their town, the NFL made, in a single year, over $7 billion in broadcasting rights alone, and no taxpayer received a single NFL tax credit.

Why should our State and local governments use YOUR money to fund this multi-billion dollar industry?
Perhaps we should have this discussion with our State and municipal representatives and demand they stop using your tax dollars to give handouts this billion dollar NFL industry.
